tennisTOUCH - Terms and Conditions
Service
· This agreement represents a contract between you (member) and NET SPORT d.o.o., the provider and the owner of the tennisTOUCH solution and services.
· This agreement sets out the terms and conditions that describe and govern your use of the service as defined below.
· The Service is and remains the property of company NET SPORT d.o.o or other third parties and is protected by copyright laws and international copyright treaties. By using the service or it's future extensions, you are accepting the terms of this Agreement. By creating your account at tennisTOUCH, you accept this Agreement. By accepting this Agreement, you confirm that you fully understood it, irrespective of the fact that English may not be your native language.
· The following words and expressions shall have the following meanings:
tennisTOUCH refers to: the Services provided by NET SPORT d.o.o. and its professional associates.
Member refers to: a person that has agreed with these terms and conditions and have joined tennisTOUCH community as a member.
· tennisTOUCH aims and goals are to provide community environment for its members, so they can post and share various content. The goal of tennisTOUCH is to empower members so they can safely, easily and professionally provide, share and exchange their personal content and exchange information with other members of the tennisTOUCH community.
· tennisTOUCH offers subscribed a services community for: players – both professional or amateur, active or recreational, trainers, coaches, tournament organizers and other people involved.
· tennisTOUCH provides member profile hosting through tennisTOUCH website and mobile aplications that are part of tennisTOUCH. Members can also access profiles of other members and use various member to member services.
· Members are responsible for the content of their own individual profile. tennisTOUCH assumes that members own their content or/and own IP (Intellectual Property) over the content they provided.
· tennisTOUCH does not support any type of exploitation of their members or any misuse of information provided by members. With that in mind, tennisTOUCH is designed to operate in a transparent and trustful way.
· Members are responsible to comply with these terms and conditions. tennisTOUCH holds no responsibility for any violations of these terms.
· tennisTOUCH uses third party payment systems available or enabled in your country, and holds no responsibility for any possible damage caused by those systems.
· Members agree not to provide any unlawful, malicious, misleading or discriminatory content of any kind. Failure to follow these terms and conditions could result in permanent removal of the member profile, without notice or refund.
· Members agree not to provide any content which constitutes a criminal offence, violates other members' rights or violate any local, national or international law. Failure to follow these terms and conditions could result in permanent removal of the member profile, without notice or refund.
· Members agree not to use or post any content which violates local, national or international law including International trademark or copyright laws and restrictions in any way. Failure to follow these terms and conditions could result in permanent removal of the member profile, without notice or refund.
· Members agree to take sole responsibility for the content communicated on tennisTOUCH Website and any of its current and future services including but not limited to mobile applications.
· Members agree not to hold tennisTOUCH responsible in any way for any content or information provided by other members, or any actions resulting from content and information provided by members.
· Content is the responsibility of the members. tennisTOUCH has no obligations to check, control, modify, censor or intervene in any way in content provided by member. tennisTOUCH will remove inappropriate content on the best effort basis.
· Members agree and acknowledge that tennisTOUCH does not control content posted by members, but reserves the right to remove, change or modify, as seen appropriate, any content without notice.
· tennisTOUCH is a hosting service and is not responsible for any information provided by members including statement, opinion, advice, recommendation, neither is liable for such information provided by members.
· tennisTOUCH reserves the right to refuse or remove inappropriate content at its sole discretion, including any text, images, videos or URLs.
BY ACCEPTING THESE TERMS AND CONDITIONS, YOU EXPRESSLY AGREE THAT:
1. The use of the tennisTOUCH service and the site is at your sole risk and responsibility. tennisTOUCH does not guarantee that the service or the site will be uninterrupted or error free.
2. The service is provided "AS IS," and tennisTOUCH expressly disclaims any implied or expressed warranties or conditions of any kind.
3. Although tennisTOUCH attempts to provide accurate information about the service to members, tennisTOUCH does not assume any responsibility with the respect of the accuracy or completeness of such information.
4. Although tennisTOUCH attempts to provide accurate information supplied by its partners and affiliates, tennisTOUCH does not assume any responsibility for, or make any representation with the respect of the accuracy or completeness of such information.
5. tennisTOUCH is not and will not be liable for any abusive, offensive or illegal conduct by members or other third party.
6. tennisTOUCH and its associated affiliates shall not be liable for any infection by any virus, malware or damage to any computer that results from the access or the use of the service or the site or downloads of any intellectual property or URLs pointing to other service, content or website where such damage may occur.
7. tennisTOUCH and its associated affiliates shall not be liable for any intellectual property (IP) damage or loss.
8. tennisTOUCH shall not be obliged or responsible for any loss or damage caused in whole or in part by any kind of "force majeure".
9. tennisTOUCH shall not be obliged or responsible for any loss or damage caused in whole or in part for any action taken as a response to or as a result of any information available on the service and the sites. You hereby waive any and all claims against tennisTOUCH and its affiliates, unless otherwise established by applicable law.
10. In no event shall tennisTOUCH and its affiliates be liable for any damages whatsoever, including, without limitation, special, indirect, consequential or accidental damages, including, without limitation, damages resulting from the use or reliance on the information presented, loss of profits or revenues or cost of replacement of goods or any other damage, unless otherwise established by applicable law.
11. You will use the tennisTOUCH service in compliance with your country data protection laws and you promise to tennisTOUCH that you will comply with all such data protection laws regarding your use of service.
12. You will provide tennisTOUCH with correct and accurate information reasonably requested by tennisTOUCH.
· If any part of this agreement is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, it shall to that extent be severed from the remainder of the agreement, which shall continue to be valid and enforceable.
· If for whatever reason any other person or party which is not part of tennisTOUCH community claim any damage, expenses or legal fee as a result of your use of service, you agree to defend, indemnify and hold harmless tennisTOUCH and its affiliates.
· tennisTOUCH shall at any time have the right, to change, suspend, discontinue, withhold or refuse access to any aspect or feature of the service or the site, without notice, including, but not limited to content, hours of availability and equipment and software needed for access or use. tennisTOUCH may also impose limits on certain features and services or restrict your access to parts or the entire service or site without notice. tennisTOUCH has the right to withdraw the service or any part thereof or terminate this agreement if tennisTOUCH ceases, for whatever reason, or no longer retains the right to license the service or any part thereof, or if, in tennisTOUCH's sole discretion and on reasonable grounds believes that the service or any part thereof contains any material which infringes copyright or is false, unlawful, or otherwise objectionable. tennisTOUCH could permanently remove such member without warning or refund.
· tennisTOUCH may wish to identify you in its marketing materials as a subscriber or licensee of the service, or as a reference. Your use of the service indicates your permission for tennisTOUCH to use your personal data in this manner unless you notify tennisTOUCH otherwise, in writing.
· tennisTOUCH shall have the right at any time to change or modify the terms of this agreement and the terms and conditions applicable to your use of the service, or any part of it, or to introduce new service with new conditions including changing fees and charges and such changes shall be effective immediately at tennisTOUCH discretion. By your continuing use of service after such notice shall be assumed as acceptance of such changes, modifications or additions.
· Members of tennisTOUCH community may receive updates, notification or emails by other members or by the tennisTOUCH team, as new services are launched.
· tennisTOUCH does not monitor or supervise any web site linked to the service or provided by member.
· Members acknowledge that tennisTOUCH is not responsible for any accuracy of other members content.
· Links to or any inappropriate reference to any inappropriate site, as determined by tennisTOUCH, are strictly forbidden.
· tennisTOUCH will not support the promotion of services or other organizations that oppose to the original purpose of tennisTOUCH and such referrals and/or members could be removed without notice or refund.
· tennisTOUCH does not support the linking of images from tennisTOUCH to other sites, or the misuse of links from other sites to tennisTOUCH. Copying other tennisTOUCH members content to other sites or inappropriately linking is forbidden. A member could be removed without notice or refund
· Member can remove account from tennisTOUCH at any time. When deleting an account, members' content is deleted. However, some information may remain in backups and logs for some time.
· tennisTOUCH under any circumstance may not be held responsible for any damage or loss related to possible abuse or misuse of content of any member by other member.
· Disputes: Any potential controversy or claim arising out of or relating to this contract and Terms and Conditions, or the breach thereof, should firstly be settled in an amicable way by mutual reasonable efforts. Otherwise, competent court would exclusively be Croatian court and applicable law would exclusively be Croatian law.

· If we disable or delete your account, you will not create another one without our permission.

· We will never sell, rent, or lease our members' lists to third parties. We may enable the use of information to our affiliates in order to provide services, without providing information themselves.
· You can change and update your personal information any time.
